Civil appellate cases will go before the Alabama Court of Civil Appeals and/or the Alabama Supreme Court, depending on the situation. The Court of Civil Appeals reviews civil lawsuits where the amount in controversy does not exceed $50,000. They also review rulings in divorce cases and other family court proceedings, as well as handling appeals in certain administrative cases. In addition to handling cases that fall under their direct jurisdiction, the Court of Civil Appeals sometimes rules on cases transferred to it by the Alabama Supreme Court.
The Alabama Supreme Court has the authority to review the decisions reached by any of Alabama’s lower courts, including the Alabama Court of Civil Appeals and the Alabama Court of Criminal Appeals. They also have direct jurisdiction over civil appeals where the amount in controversy is greater than $50,000, over certain probate court appeals, and in other situations where no other court in Alabama has jurisdiction.
